Right of Withdrawal and Right to Cancel
This notice applies to consumers in the European Union and sits alongside your other statutory rights. Your contract of sale is with Charlie Mackesy Limited.
To withdraw from your order, use our Withdraw from contract form (no account or login needed).
Tip: cancel before it is printed and save the return cost. Your order is usually printed the day after you place it. If you contact us at support@charliemackesy.com before it goes to print, we will cancel it and refund you in full, with nothing to send back and no return postage to pay. Your 14-day right of withdrawal below still applies after your order has been printed and delivered; in that case you arrange a return and pay the return postage.
1. Your right to withdraw
If you are a consumer in the EU, you have the right to withdraw from your contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day on which you, or a third party other than the carrier indicated by you, acquire physical possession of the goods. Where your order is delivered as several separate items, the period runs from the day you receive the last item.
2. How to withdraw
To exercise your right, you must tell us your decision by a clear statement. You can:
- Use our "Withdraw from contract" form on our website (no account or login needed); or
- Complete the model withdrawal form below and send it to us; or
- Send any other clear statement of your decision by post or email.
Our details:
Charlie Mackesy Limited (company number 12326204, registered in England and Wales)
35 Edgington Way, Sidcup, DA14 5BH, United Kingdom
VAT number: GB354713889
Email: support@charliemackesy.com
To meet the deadline, it is enough that you send your communication before the 14-day period expires. We will send you an acknowledgement of receipt without delay.
3. Effects of withdrawal
If you withdraw, we will reimburse all payments received from you, including the cost of standard delivery (but not any extra cost arising from your choosing a delivery type other than the cheapest standard delivery we offer). We will make the reimbursement without undue delay, and no later than 14 days from the day we are informed of your decision. We will use the same means of payment you used for the original transaction unless you expressly agree otherwise, and you will not incur any fees as a result. We may withhold reimbursement until we have received the goods back, or you have supplied proof that you have sent them back, whichever is the earlier.
4. Returning the goods
To arrange your return, contact us at support@charliemackesy.com. Returns should be sent to Charlie Mackesy Limited, 35 Edgington Way, Sidcup, DA14 5BH, United Kingdom. You must send the goods back without undue delay and no later than 14 days from the day you tell us you are withdrawing. The deadline is met if you send the goods before the 14 days expire. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning.
5. Exceptions
The right of withdrawal can be excluded by law for certain goods, such as items personalised to you (for example printed with your own name or photo) or sealed goods that are not suitable for return for health or hygiene reasons once unsealed. Our current range does not include any such items, so the 14-day right of withdrawal applies to everything we sell. If we ever offer a personalised or made-to-order product that is excluded, we will say so clearly on the product page before you buy.
Right to Cancel (UK customers)
If you are a consumer in the United Kingdom, you have the right to cancel your contract within 14 days without giving any reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The length of the cancellation period, the way it is calculated, the effects of cancelling, the arrangements and deadline for returning the goods, and your liability for any diminished value are the same as set out in points 1, 3 and 4 above for EU customers.
To cancel, you must tell us your decision by a clear statement. You can use the model cancellation form below, or send any other clear written statement to Charlie Mackesy Limited, 35 Edgington Way, Sidcup, DA14 5BH, United Kingdom, email support@charliemackesy.com. To meet the deadline, it is enough that you send your communication before the 14-day period expires.
Almost all of our products are standard items and remain fully cancellable. Print-on-demand items, including our t-shirts and tea towels, are not treated as personalised and are not excluded. If an item is genuinely personalised to you and therefore excluded, we will say so clearly on the product page before you buy.
